Terms of Service

These Terms of Service ("Terms") govern your access to and use of EmbroidAI's website, applications, embroidery digitizing tools, file viewers, AI features, and related services (collectively, the "Service"). By creating an account, uploading a file, or otherwise using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not access or use the Service. If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate, current, and complete information when registering and to keep that information up to date. Notify us immediately of any unauthorized use of your account.

EmbroidAI provides AI-powered embroidery digitizing, automatic stitch generation, design analysis, and a browser-based viewer and preview for embroidery files such as DST, PES, EXP, JEF, and VP3. Features, tools, and supported formats may change, expand, or be discontinued over time at our discretion.

Generated stitch files are produced automatically and may require review or adjustment before production. You are responsible for verifying any file before sewing or commercial use.

Certain features consume AI credits or require a paid plan. Credit allowances, plan limits, and pricing are described on the Service and may be updated from time to time. Unless stated otherwise, credits have no cash value and may expire according to your plan.

Paid subscriptions renew automatically until cancelled. Except where required by law, fees already paid are non-refundable. You are responsible for any applicable taxes.

You retain ownership of the artwork, images, and embroidery files you upload ("Your Content"). By uploading Your Content, you grant EmbroidAI a limited, worldwide license to host, process, store, and transform it solely to provide and improve the Service to you — for example, to generate stitches, render previews, and produce output files.

You represent that you own or have the necessary rights to Your Content and that it does not infringe any third party's intellectual property, privacy, or other rights. You are solely responsible for the files you upload and the designs you produce.

You agree not to use the Service to:

• Upload or generate content that is unlawful, infringing, or violates another person's rights.
• Reverse engineer, scrape, overload, disrupt, or attempt to gain unauthorized access to the Service or its infrastructure.
• Resell, sublicense, or redistribute the Service itself without our written permission.
• Use automated means to abuse credits, free tiers, or rate limits.

We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Service or other users.

The Service, including its software, AI models, designs, branding, and all related intellectual property, is owned by EmbroidAI and its licensors and is protected by applicable laws. Except for the rights expressly granted to you in these Terms, no rights are transferred to you. You may not use the EmbroidAI name or logo without prior written consent.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. EmbroidAI does not warrant that the Service will be uninterrupted, error-free, or that generated files will be suitable for any specific machine, fabric, or production run.

To the maximum extent permitted by law, EmbroidAI and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, materials, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months preceding the claim.

You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service if you breach these Terms or if we discontinue the Service. Upon termination, the rights granted to you under these Terms will end, while provisions that by their nature should survive (such as ownership, disclaimers, and limitation of liability) will remain in effect.

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
